General T.O.S

By commissioning me, you understand and agree to my T.O.S

☆ Intellectual property
▫️All rights reserved to the artist : By default, I have the right to post the commissioned artwork online as samples for future clients, record process, include them in my portfolio, archive or any platforms
▫️In any case where the artwork is showcased or posted online, please give credit (art by @humancreates on Instagram / Twitter / Toyhou.se). Especially on Twitter, I don’t mind the notifications so please tag me correctly and avoid breaking the tag with @. or @/
▫️Do not edit / crop / trace / claim my artwork as your creation☆ Payment and Refund policy
▫️I accept payment made with credit/debit card via my ko-fi website only (Stripe it's just like any other online checkout and accepts cards and bank transfers)
▫️Commissions do not function on a first-come first-served basis. The accepted requests will be based on how well I'll be able to draw the character in order to ensure quality work, so slots are not guaranteed
▫️Illustration, sketch and custom design commissions require full upfront payment
▫️Split payments are acceptable for orders above 500€ (vtubers model art and big commission)
▫️Full refund is not allowed once the payment has been done. Unless I, the artist, want to cancel the commission, I will refund around 90-95% (due to transaction fee)
▫️Due to the supply and demand, I might update my pricelist anytime between commission openings. This doesn’t apply if I already sent you a fixed quote☆ Revision
▫️I will only do changes in the sketching and coloring phase
▫️Any big change might occur additional fee, which depends on the change itself☆ Progress
▫️It takes anywhere from 1 to 2 months after the sketch for me to finish one commission
▫️I update the progress tracker regularly
▫️If it's super urgent, you can choose to pay ×2 the price, and your order will be on top of the waiting queue
▫️Please be patient and respectful☆ Privacy and usages
▫️Commissions can only be used by the respective commissioners or the ones who receive as gifts
▫️If the art is used to promote your service or making profits (physical printing / music cover / donation purpose...) you have to tell me in advance
▫️Selling and minting any of my artworks or commissions as NFT is strictly prohibited. I do not associate myself with any cryptocurrency or NFT. If you see my art on platforms relating to those, please notify me
▫️I do not allow to use my art to generate AI “art” neither☆ Files
▫️You, the Client, are responsible for saving any information, images, and other digital data I provide
▫️Any file you paid for will be available from me for a finite time only. However, I cannot guarantee against computer failure or accidental deletion or loss
▫️I am not required to post your project in any public space, and if posted, I am not required to keep it there indefinitely. I have the right to delete or remove any public project, even if you paid for it, as you should have your own copy for personal use☆ Banning
▫️Commissioners who behave without respect, try to scam (profit off my works without my consent) or fail to respect this T.O.S will be blacklisted and blocked

Vtuber models / pngtuber T.O.s

▫️Vtuber and PNGtuber illustrations are categorized as commercial work, meaning you're allowed to use the model for streaming use (Twitch, YouTube, any stream platforms)▫️You must credit me clearly as the model artist on your Twitter bio and Twitch/Youtube credit section▫️For company / talent agency, prices will be x2 to x5 depending on company / agency’s size▫️In the case you wish to resell the model, please notify me first and don't price it for more than you paid for /// If you win a free model art or vtuber design from a raffle I host, you can make streaming contents with it but you cannot resell it▫️I retain the rights to post showcases and commissioned work on my portfolio and social media. Please inform me if you'd like to maintain the model private until debut▫️In order to keep the workflow constant and on schedule, please reply and provide feedback in a timely manner▫️In case you don’t give me proper credit as your model artist or designer, I am free to block you and not work with you anymore.
